How Foreigners’ Are Protected in China’s Copyright Industry?

摘要：讲座主要阐述三个问题：第一，中国著作权法体系的概述。分别介绍著作权法的法律渊源、作品的概念以及特征、作者以及其著作权人身权、财产权的具体内容、邻接权、合理使用和作品的保护期限；第二，中国著作权法如何保护外国人及其作品。从著作权法具体条文出发，阐述国内法对国际条约内容的吸收，以及保护外国人的条件、国民待遇、诉讼管辖以及相关案例等内容；第三，介绍了我国在著作权以及知识产权保护方面取得的成绩及近期主要发展措施。

Abstract: The lecture mainly presents three major issues: First of all, the introduction to China’s copyright system, which includes the legal resources、 copyrighted works、the authorship and the author’s moral and economic rights、neighbouring rights、fair use and the terms of protection. Furthermore, it explains how foreigners are protected in China’s copyright industry, which focus on the national treatment, jurisdiction and specific case.  Finally, it presents China’s reform and development in IP protection in recent years.

摘要：国际法是大国外交政策的重要制度工具。作为中国对外政策的总体规划，“一带一路”倡议具有深远的国际和国内影响，是理解中国国际法行为的最佳窗口。本讲座拟在介绍“一带一路”倡议的基础上，讨论中国对“一带一路”建设的国际法安排，并以此分析中国国际法政策的国际和国内维度。本讲座从中国国际崛起和国内发展两个维度，构建解释中国国际法政策的理论框架，并结合主权、安全、发展领域的热点问题加以研讨。

Abstract: International law is an important institutional instrument for great powers diplomacy. As a grand strategy for China in new era, the Belt and Road Initiative is of profound international and national impacts within and beyond the region, and thus is the best window for observing and understanding China’s approach to international law. On the basis of brief introduction of the Belt and Road Initiative, this lecture will outline the international legal framework for Belt and Road cooperation and compare both the international and national implications thereof. This lecture proposes a theoretical framework to explain China’s approach to international law, arguing that international law functions as a tool to facilitate both the international institutional rise and domestic reform of China, and discusses recent cases concerning the sovereignty security and development issues in the region.

Judicial Reasoning in Traditional China and Its Impact on Modern China

摘要： 中国悠久的法律史在瞿同祖的《中国法律与中国社会》里得到了很好的解读。但是，仍然有很多话题值得进一步推进，我将聚焦于中国古代法律制度和法律文化，因为他们不但源于2000年前，而且影响至今。虽然老的法制体系随着清代王朝灭亡而消失，但是旧法律体系的文化仍然存在并影响着当代中国，尤其在有影响的案例中，人们用传统的法律文化来论证他们在现代语境中的立场。就此而言，中国当前的司法改革必须对旧法律体系中的法律推理所展示的法律思维与法律文化有所关注。

Abstract: China’s long legal history is cogently analyzed by TUNG- TSU CH’U in the book Law and society in Traditional China. Obviously, there are topics deserving further research and in this talk I would like to focus on China’s old legal system and culture since some of their aspects last for more than 2000 years while others have been subject to some important transformations.

Although the old legal system formally ended with late Qing Dynasty’s legal reform at the beginning of the 20th century, the legal culture of the old system survived and is still alive in modern society in China. For instance, in some special cases, people use such traditional legal culture as a source of their arguments. And for this reason, China’s current judicial reform aiming to improve judicial reasoning also has to take into account the legal culture of the old legal system.

Abstract: This course will introduce the development of internet in China and problems of cybercrime which aroused wide discussion. In this course you will learn about cybercrimes along with the development of internet in China and countermeasures in Chinese Criminal Law. Typical cases and hot issues of cybercrimes in China will be shared, and we can discuss about new cybercrimes, such as artificial intelligence crimes.

A Community for the People, by the People, for the People: the Legal Perspective Understanding towards the Belt and Road

摘要：讲座首先简要介绍“一带一路”概念提出的背景、目标、措施和取得的成就。接着从法哲学层面对人类命运共同体的内涵进行介绍；并在此基础上，重点介绍“一带一路”倡议将会对“一带一路”区域内的制度建构和治理结构带来的影响，其中将着重探讨“一带一路”建设原则本身的内涵及其与人类命运共同体之间的关系。之后，在探讨一带一路各参与方之间的动态互动的基础上，提出将“一带一路”打造成一个民有民治民享的共同体所面临的问题和可能的应对策略。

Abstract: The lecture first briefly introduces the background and objects of the Belt and Road Initiative (BRI), and measures adopted and progress achieved in implementing the BRI. Then, it starts from the discourse of the concept of Community with a Shared Future for Mankind (CSFM), to introduce the impact of BRI on the institutional construction and governance structure in the region of Belt and Road. With the emphasis on the principles of BRI, the lecture analyzes the problems faced by the initiative if we want bring the BRI into a Community of the People, by the People, for the People and discusses kinds of probable countermeasures.

Abstract: Being the cream of the Chinese culture, Beijing Opera is well-known all over the world. Beijing Opera has a history of more than 200 years and Beijing Opera masks have become the symbol of Chinese culture. Many countries design posters using Beijing Opera masks to signal a “Year of Chinese Culture.” To understand Chinese culture, therefore, some knowledge about Beijing Opera is indeed indispensable. In the lecture, the history of Beijing Opera，four roles in Beijing Opera and Beijing Opera Performance: Sing, Speak, Act and Fight will be introduced with the help of power point and videos. In addition, you have the chance to draw the Beijing Opera mask you like to help you have a better understanding of Beijing Opera.

中国“一带一路”投资保护的挑战与因应

The Challenges and Strategies of China's Investment Protection in "The Belt and Road" Area

摘要：“一带一路”倡议有可能对国际地缘政治格局和未来的政策决定产生深远影响，它可能为相关国际投资协定（IIAs）的调整和改革提供机会。本讲座将从定量和定性的角度分析中国与一带一路沿线国家缔结的投资条约，首先考察中国对外直接投资（ODI）和来自一带一路国家的直接投资（IDI）；接着总结了中国投资条约的不同发展阶段；而课程的重点部分则是通过分析中国与一带一路沿线国家缔结的投资条约，总结其特点和有效性，并在此基础上，探讨现有的投资条约网络是否足以在保护外国投资和促进东道国的经济和社会发展之间取得平衡；最后，对一带一路投资条约网络存在的缺陷和问题提出应对策略。

Abstract: The "One Belt One Road"(OBOR) Initiative has the potential to profoundly impact the international geopolitical landscape and future policy decisions. It may present an opportunity for the adaptation and reform of relevant international investment agreements (IIAs). This lecture analyzes, from a quantitative and qualitative perspective, the current network of IIAs between China and the OBOR countries (OBOR IIAs). The lecture first examines China's outbound direct investment (ODI) to and inbound direct investment (IDI) from the OBOR countries. Then, it summarizes the various development stages of Sino IIAs. After that, it turns to the IIAs between China and the OBOR countries and analyzes their features and effectiveness; and on this basis, it discusses whether the present network of OBOR IIAs is sufficient for striking a balance between protecting foreign investment and promoting the host states' economic and social interests. Finally, it suggests preliminary steps for improving this growing IIA network.

赛艇的发展与工业水平的发展息息相关，随着现代工业制造水平的革新，赛艇的器械，训练模式也在飞速发展。赛艇运动属于多固液耦合自由度的复杂力学问题，涵盖流体力学，力学，运动学，材料学，生物力学，生理学等学科，是对科研投入要求最高的体育项目之一。

在新的时代背景下，各种新型工程技术发展飞速，未来赛艇的发展方向也必将与新兴技术的发展息息相关。

教学目标

本课程将通过理论学习和实践学习的方法，让学生在参加赛艇训练的过程中，了解赛艇运动发展史及现状，了解器械机理及使用方法，初步掌握赛艇基本训练法，结合实际工程背景对赛艇运动的展开深入探讨。

授课方式：

本课程采用实践课的授课方式，上课地点为主楼B负一层西安交通大学学生赛艇俱乐部训练房。

课程分三部分，第一部分为材料学习及参观训练方，安排教练员讲解，介绍赛艇运动发展史，器械原理及交大赛艇发展情况；第二部分为赛艇的基本训练方法及赛艇精神的阐述，教练员组织同学完成赛艇运动基本训练，安排划船器比赛体验环节；第三部分为讨论课程，组织学生结合自身工程背景，从展新型制造工艺，建立几何模型对艇只结构优化，赛艇运动的动力学分析等方面展开讨论

Overview

Rowing originated in Britain and is an important component of the Olympic Games. It has a unique spirit and cultural connotation of rowing and is highly praised as “the Product of Industrial Civilization”. The development of rowing is closely related to the development of industrial level. With the innovation of modern industrial manufacturing level, the equipment and training mode of rowing are also developing rapidly. Rowing is a complex mechanical problem with multi-solid-liquid coupling degrees of freedom. It covers hydrodynamics, mechanics, kinematics, materials science, biomechanics, physiology and other disciplines. It is one of the most demanding sports projects for scientific research.

With the rapid development of various new engineering technologies, the future direction of rowing development will also be closely related to the development of new technologies.

Teaching objectives

Through theoretical and practical learning, this course will enable students to understand the history and current situation of rowing sport, understand the mechanism, grasp the basic training methods of rowing preliminarily, and explore rowing sport in depth in the light of practical engineering background.

Teaching methods:

This course is taught in a practical way. The location of the course is the training room of the student rowing club of Xi'an Jiaotong University on the basement one of the main building B.

The course is divided into three parts:

The first part is material learning and training club visiting. We will arrange coaches to give the students explanations, namely introducing the development history of rowing, the principle of equipment and the development of rowing at Xi’an Jiaotong University;

The second part is the elaboration of the basic training methods and the spirit of rowing. The coaches organize their classmates to complete the basic training of rowing and arrange the experience of rowing competition;

The third part is the discussion course. The coaches will organize the students to discuss the new manufacturing technology, the geometric model, the structural optimization of the boat and the dynamic analysis of the rowing movement based on their own engineering background.
